JOURNIE Rewards* Program Terms & Conditions.

GENERAL

The Journie Rewards Program (the “Program”) is a loyalty reward program that is operated by Parkland Corporation (“we”, “us”, “our” or “Parkland”). The Program operates only through participating Pioneer, Fas Gas, Ultramar, Chevron and On the Run stations, or others as determined by Parkland from time to time (collectively, “Participating Stations”) and/or the businesses of third-party vendors authorized by Parkland for the earning of Program points (“Points”).

By participating in the Program, you agree that you have read and understood these Terms and Conditions, which may be changed by Parkland in its discretion from time to time, and you agree to the collection, use and disclosure of your personal information for the purposes of this Program, in accordance with the Privacy Policy on the Program website.

PARTICIPATING STATIONS

The list of Participating Stations, as amended from time to time, is available at www.journie.ca (the “Program’s website).

HOW TO REGISTER

Individuals can register for the Program via the App or Journie Rewards Card, both as defined below.

BY MOBILE APP

To participate in the Program by mobile phone, download and install the official Program application (the “App”) from the Apple App Store or the Google Play App store on your mobile device, fully complete the registration process for a Program account (an “Account”) and agree to the App and Program Terms and Conditions. You will then automatically be registered to participate in the Program. The individual (the “Participant”) who completes the registration process with a valid mobile phone number (the “Phone Number”) via the App is deemed to be the authorized Participant and Account holder. Enrollment and participation of any Participant in the Program is at the sole discretion of Parkland.

In the event that a password is forgotten, misplaced, lost, stolen, or is used in any unauthorized way, the Participant may request a new password by confirming their Phone Number or email address on the App. In the case of confirming Phone Number, an automated SMS text message will be sent to reset the password. In the case of confirming email address, an automated email will be sent with a link to reset the password, upon the Participant successfully answering a challenge question.

It is the responsibility of the Participant to ensure that their password is always secured from unauthorized use. Parkland assumes no responsibility or liability for the unauthorized use of any password regardless of the circumstances. Your password should be long, difficult to guess, and not contain any personal information (such as a birthday). Never disclose your password to anyone.

If a Participant suspects that someone other than the Participant has knowledge of their password, the Participant must change it immediately by contacting the Program’s Customer Service using the telephone number in the Contacts section below or by changing their password themselves in the App.

Only one Account is issued and permitted per individual.

BY JOURNIE REWARDS CARD

To participate in the Program with a Journie Rewards Card (a “Journie Rewards Card”), you may obtain a Journie Rewards Card at any Participating Station simply by requesting one. The Participant receiving the Journie Rewards Card is deemed to be the authorized Account holder. The Journie Rewards Card may only be used once the attendant at the Participating Station activates it by electronically registering it into the Program’s computer system at the same time a Participant makes their first purchase.

Once activated, Points can be earned to the Participant’s Account. A Participant will not be able to redeem Rewards until the Participant registers the Journie Rewards Card via the App, Program website or by contacting the Program’s Customer Service using the telephone number in the Contacts section below. Once registered, the Participant may be required to verify their identity via the link provided in the registration email. Enrollment and participation of any Participant in the Program is at the sole discretion of Parkland.

In the event that a password is forgotten, misplaced, lost, stolen, or is used in any unauthorized way, a new password will be provided to the Participant once the Participant clicks on the “Forgot password” link on the Program’s website or informs Program’s Customer Service using the telephone number in the Contacts section below. Parkland will then disable the old password.

It is the responsibility of the Participant to ensure that their password is always secured from unauthorized use. Parkland assumes no responsibility or liability for the unauthorized use of any password regardless of the circumstances. Your password should be long, difficult to guess, and not contain any personal information (such as a birthday). Never disclose your password to anyone.

If a Participant suspects that someone other than the Participant has knowledge of their password, the Participant must change it immediately by contacting the Program’s Customer Service using the telephone number in the Contacts section below or by changing their password themselves on the Program’s website.

The Journie Rewards Card is not a credit card but is a loyalty card. The Journie Rewards Card is the property of Parkland.

Only one Account is issued and permitted per individual.

ELIGIBILITY

To be a Participant of the Program, an individual must, at the time of registration, be sixteen (16) years old or older and a legal resident of Canada.

Only individuals may become Participants of the Program. Corporations, businesses, and partnerships cannot become a Participant.

Participants are responsible for notifying Parkland of any changes to their Account including mailing address, Phone Number, and/or e-mail address. Participants are responsible for any consequences of a failure to notify Parkland of any such changes. To update a Participant’s Account, the Participant may update their profile at any time in the App or on the Program’s website or use any of the communication methods outlined under the Contacts section below. Parkland is not responsible for any consequences resulting from any misdirected communications.

HOW TO PARTICIPATE

Participants can identify themselves at Participating Stations in one of three ways: by scanning the digital card in the App, providing the Phone Number linked to the App, or scanning the Journie Rewards Card.

COLLECTION OF POINTS

Once an Account is activated, Participants can earn Points in a number of ways, including through certain eligible purchases or other actions, as determined from time to time by, and at the sole discretion of, Parkland (“Additional Earnings”).

Points are earned through the purchase of certain products, merchandise or services from Participating Stations or other partners and suppliers, as Parkland may identify from time to time. This includes the following:

Results with a fractional part less than 0.5 will be rounded down, and results with a fractional part greater than or equal to 0.5 will be rounded up.

Points may also be earned through time-limited promotional offers from Parkland or participating partners and suppliers. Some Additional Earnings may be customized.

Parkland may, on such terms, conditions, and limitations as it may, in its sole discretion, establish from time to time, permit loyalty rewards earned under a rewards program offered by a third party to be converted into Points.

Additional Earnings are subject to any additional terms and conditions set out on the Program website or App, and only for the time period for which we make such offers available. Additional Earnings may be dynamic and subject to change depending on inventory availability, time of redemption and a series of other factors that are determined by Parkland and participating partners and suppliers.

All opportunities to earn Points, including their rates, availability, time periods and other details, are subject to change at Parkland’s sole discretion and without further notice to Participants.

Participants must present their App (scan digital card on App or enter Phone Number linked to App) or their Journie Rewards Card to collect Points before the payment is processed for the transaction. If a Participant does not do so, there will be no retroactive awarding of Points. The only opportunity to earn Points is at the time of an actual purchase in conjunction with the presentation of the App (scan digital card on App or enter Phone Number linked to App) or their Journie Rewards Card, unless expressly indicated otherwise by Parkland.

The maximum amount of Points that may be earned for any single gasoline or diesel transaction is one hundred fifty (150) Points. The maximum amount of Points that may be earned for any single merchandise or service transaction is two hundred (200) Points.

Points will be earned on the pre-tax price of merchandise or services, excluding gasoline or diesel, after any discounts are applied.

Points cannot be earned for the purchase of some merchandise and services, which may include natural gas, alcohol (in some regions), tobacco, gift cards, prepaid long-distance cards, prepaid cellular cards, bill payments, merchandise or services that are excluded by law, and other merchandise or services specified by Parkland as exclusions from time to time. Points may be earned by Participants of legal age on the purchase of alcohol where applicable and where the Program is offered. Rewards of discounted alcoholic beverages may be offered to Participants of legal age where applicable and where the Program is offered.

Participants must be legal age to purchase lottery, alcoholic beverages and tobacco. Government photo ID is required.

Points earned on a transaction will be shown on the printed receipt issued at the time of purchase. In the event that the computer server used to record Points is unavailable at the time of purchase, Points for the purchase will be earned automatically when the system becomes available and the new balance will be available on the Program’s website or App.

In the event of a discrepancy between the Points earned, the balance on a receipt, the Points posted on the Program’s website or in the App, and/or the information contained in Parkland's internal database, the information appearing in Parkland's internal database will govern. The information appearing on the Program’s website or App is initially generated from the computer system that records individual transactions as they occur at Participating Stations and for this reason the information appearing on the Program’s website or App may not accurately reflect the information contained in Parkland's internal database at the time of viewing a Participant’s Account on the Program’s website or App.

If a Participant believes there is a discrepancy with the number of Points earned on a particular transaction, the Participant has thirty (30) days from the date of the transaction on the receipt to contact the Program’s Customer Service at the telephone number under the Contacts section below and report the matter. After thirty (30) days from the date of a given transaction, any amount of Points appearing in relation to that transaction in Parkland's internal database that has not been questioned by a Participant may be deemed final and not be changed regardless of the circumstances.

If Points are not earned or redeemed in accordance with these Terms and Conditions and any other terms or conditions dictated by Parkland from time to time, Parkland reserves the right, in its sole discretion, to adjust the Participant’s Account.

Parkland, at its sole discretion, reserves the right to take any action or make any decision that preserves the integrity of the Program.

In the event of returns and/or exchanges, Points will be deducted from the Participant's Account in the same amount as the number of Points earned for the returned merchandise or service.

Points are not divisible in the case of legal disputes, including marital disputes such as separation or divorce. Points are automatically forfeited, and the Participant’s Account is automatically reduced to a balance of zero (0), at the time an Account is closed, or upon their death, or at the time of their bankruptcy, or if there is no activity on their Account (no Points earned or redeemed Rewards) for one year. No credit of any kind will be given to the Participant at any time for unclaimed Rewards. The accumulation of Points does not entitle a Participant to any rights to any Points. Points remain the property of Parkland at all times.

From time to time, selected in-store merchandise and/or services may be eligible for Additional Earnings. In these cases, the amount of extra Points advertised in-store will be earned in addition to the base amount earned pursuant to the information available on https://journie.ca/en-CA/universal-offers or in the App. Parkland reserves the right to change Additional Earnings at any time at its discretion.

At Participating Stations, a Participant will be able to earn Points when they make payment with an eligible fleet payment card. However, they will not be able to take advantage of any Rewards, as defined below, during such a transaction. The Participant will be able to redeem their Rewards when they pay with a non-fleet payment card.

All references to currency in these Terms and Conditions are stated in Canadian dollars.

JOURNIE REWARDS UNLOCKS

The Program is a cyclical offer program, based on the number of points obtained as described below:

Second Level 150 Points
Third Level 300 Points

As a Participant reaches the First Level, Second Level, and Third Level, a Participant will be able to choose one of a number of time-limited offers determined by Parkland (“Rewards”). Rewards may be customized.

All Rewards are subject to these Terms and Conditions and any additional terms and conditions set out on the Program website or App, and are only available for the time period we determine. Rewards may be dynamic and subject to change depending on inventory availability, time of redemption and a series of other factors that are determined by Parkland and participating partners and suppliers.

All Rewards, including their required Points, availability, time periods and other details, are subject to change at Parkland’s sole discretion and without further notice to Participants.

As the case may be, a Participant will be notified via the App, by logging into their Account on the Program’s website, or via a message printed near the bottom of their receipt that acknowledges Rewards are ready for them to choose. Participants will have sixty (60) days to choose from a selection of Rewards available to them and redeem the chosen Reward at a Participating Station. If a Participant does not choose one of the available Rewards, or the chosen Reward is not redeemed within sixty (60) days, it will expire. A Reward cannot be changed once chosen.

As previously stated, upon reaching the First Level and Second Level, the Participant will be eligible to receive a Reward. When selecting or redeeming Rewards at these levels, no Points will be deducted from the Account, and Points will continue to accumulate until the Participant reaches the Third Level.

Once a Participant’s Account has reached the Third Level, the Participant may be offered Rewards to choose from and may claim it in accordance with the following:

By App: when signing up for the App, participants can choose a preferred Reward to receive when they reach the Third Level. The preferred Reward can be changed in the App. Upon reaching the Third Level and depending on the Reward, the Participant may either claim their preferred Reward immediately or save it for future use. Upon reaching the Third Level, the Participant's Points balance will automatically reset to zero (0), and they will begin a new cycle of accumulating Points and Rewards. The Participant will continue to earn Points in accordance with these Terms and Conditions.

By Journie Rewards Card: Once the Participant has reached the Third Level, a Reward will become available, and the Participant may claim their chosen Reward. Participants using a Journie Rewards Card do not have the option to save the Reward for a later date. Upon reaching the Third Level, the Participant's Points balance will automatically reset to zero (0), and they will begin a new cycle of accumulating Points and Rewards. The Participant will continue to earn points in accordance with these Terms and Conditions.

Various terms and conditions apply to each Reward.

JOURNIE REWARDS AND M&M FOOD MARKETTM REWARDS LINKING

To be eligible to earn Points under the Program at participating M&M Meat Shops Ltd. (“M&M Food Market”) stores, as amended from time to time and available at https://www.mmfoodmarket.com/store_locations (the “Participating M&M Food Market Stores”), the Participant must:

  • Be a M&M Food Market Rewards member (a “M&M Food Market Member”) and have a M&M Food Market account in good standing (a “M&M Food Market Account”) in accordance with M&M Food Market’s Terms and Conditions;
  • Have the App and be in good standing in accordance with these Terms and Conditions; and
  • Link the M&M Food Market Account and the Account by following the instructions on the App as more fully detailed below (a “M&M Food Market Linked Member”).

You can only link one Account with one M&M Food Market Account. You can de-link said accounts at any time. However, if you choose to de-link your accounts, you will no longer be eligible to earn Points at Participating M&M Food Market Stores.

Once you are an M&M Food Market Linked Member, each time eligible purchases (minimum and maximum merchandise purchase amount may apply) are made at a Participating M&M Food Market Stores, a M&M Food Market Linked Member will earn Points according to the terms and information set out below. With respect to merchandise purchases, the number of Points earned will be calculated separately (before tax) for each eligible in-store merchandise. The section concerning the Collection of Journie Rewards Points as set out above apply to the earning of Points at Participating M&M Food Market Stores.

JOURNIE REWARDS UNLOCKS AEROPLAN POINTS

To be eligible to earn Aeroplan points under the Program, the Participant must:

  • Be an Aeroplan Program member (“Aeroplan Member”) and have an Aeroplan account in good standing (“Aeroplan Account”) in accordance with Aeroplan’s Terms and Conditions;
  • Have the App and be in good standing in accordance with these Terms and Conditions; and
  • Link the Aeroplan Account and the Account by following the instructions on the App as more fully detailed below (an “Aeroplan Linked Member”).

You can only link one Account with one Aeroplan Account. You can de-link said accounts at any time. However, if you choose to de-link your accounts, you will no longer be eligible to earn and redeem Aeroplan Points under the Program in accordance with these Terms and Conditions. Parkland and Aeroplan each reserve the right to institute a time period of at least 30 days before you can re-link your accounts.

Once you are an Aeroplan Linked Member, each time eligible purchases (a minimum purchase amount for gas, merchandise, or services may be required) are made at a Participating Station, an Aeroplan Linked Member will earn Points according to the terms and information set out on in this section. With respect to merchandise purchases, the number of Points earned will be calculated separately (before tax) for each eligible in-store merchandise.

As the Aeroplan Linked Member reaches the First Level and Second Level as described above, Rewards will become available, and the Aeroplan Linked Member will be able to unlock one of the Rewards. From time to time, the Aeroplan Linked Member may be offered Aeroplan points or an Air Canada In-Flight Credits (“AC Credits”) in various amounts at the First Level or Second Level.

Upon reaching the Third Level, the Aeroplan Linked Member will automatically receive three hundred (300) Aeroplan points in their Aeroplan Account. Upon reaching the Third Level, the Aeroplan Linked Member's Points balance will automatically reset to zero (0), and they will begin a new cycle of accumulating Points and Rewards. By default, an Aeroplan Linked Member will automatically receive three hundred (300) Aeroplan points as their Third Level Reward.

EV Charging

At certain Participating Stations, ultra-fast charging services for your electric vehicle (EV) are available. EV charging will be available to all EV users including Participants at Participating Stations. EV users’ and Participants’ energy consumption shall be billed on a kilowatt-hours (kWh) basis. Using such EV charging services does not earn Points, apart from any deals set out on the Program website. Participants shall have the ability to pay for the charging services via the App, which accepts the following forms of payment: Apple Pay, Google Pay, Visa, Visa Debit, Mastercard, Mastercard Debit, and Amex.

LOST OR STOLEN JOURNIE REWARDS CARD

In the case of a lost or stolen Journie Rewards Card, a new Journie Rewards Card will be provided to the Participant upon request at any Participating Station. If the lost or stolen Journie Rewards Card was registered and Parkland can verify the identity of the Participant, any accumulated Points relating to the lost or stolen Account may be transferred to the new Account at the time the replacement Journie Rewards Card is registered. The lost or stolen Journie Rewards Card will then be suspended and will not be able to be used to redeem Rewards. Parkland assumes no liability for Rewards redeemed prior to the notification to Customer Service using the telephone number or email address in the Contacts section below that the Journie Rewards Card is lost or stolen.

If any Rewards are redeemed prior to Parkland’s receipt of notification, those unauthorized redeemed Points or Rewards will not be reinstated to the Participant's new Account. If a lost or stolen App or Journie Rewards Card is used by a third party after a Participant makes a proper loss notification to Parkland, Parkland shall not hold the Participant responsible for such redemptions and shall credit the applicable Points back to the Participant’s Account.

PRIVACY OF INFORMATION

JOURNIE REWARDS

The information provided by Participants in order to register for the Program will constitute personal information, as that term is defined under the Personal Information and Protection of Electronic Documents Act (“PIPEDA”), including, but not limited to, a Participant’s name, gender, postal address, and email address. While Parkland is collecting such personal information for purposes of administering the Program, Parkland may also use that information for market research purposes or to notify you of Parkland's special promotional deals unless you choose to opt out of receiving promotional communications.

Parkland does not sell any personal information from the Program to any third party. However, such information may be provided to certain third parties as required to administer the Program or to other businesses to which Parkland has extended the operation of the Program.

From time to time, Parkland may enter into business relationships with businesses that do not form part of the Program, but that will provide Program members with various promotional deals, such as discounts if a Participant were to purchase their products or services of those businesses. In such an instance, Parkland will not provide such businesses with a Participant’s personal information but will provide them with the Participant’s registered Account number so that such businesses can confirm that the Participant is a Program member when necessary. An Account number itself cannot identify anyone, but if a Participant contacts one of these businesses and provides such business with personal information, such personal information will be governed by that business’s privacy policies and not Parkland’s Privacy Policy.

Participants in the Program may choose not to form part of Parkland's marketing databases or to be contacted for promotional reasons, by selecting the appropriate response during the registration process, or at any time by using any of the contact methods outlined under the Contacts section below or by emailing Parkland’s privacy officer at [email protected].

By completing the registration process for the Program, Participants are deemed to have consented to the use of their personal information for the purposes of this Program.

Parkland assumes no responsibility or liability in the event that a Participant's personal information is accessed by unauthorized persons due to any unauthorized use by third parties of the Participant's password, whether such use resulted from some action or lack of action on the Participant's part, including for example if the Participant has lost or misplaced their password, the Participant has given their password to a third party, or the Participant did not adequately protect their password.

The Privacy Policy that governs interactions with Parkland is available at parkland.ca/en/terms-use.

PROGRAM TERMINATION

The Program will terminate at 23:59:59 Eastern Time on December 31, 2030 (the “Termination Date”) and all Points will expire at 23:59:59 Eastern Time on December 31, 2031, unless prohibited by law.

PROHIBITED CONDUCT

Participation in the Program is a privilege that can be suspended, revoked, or terminated at any time, for any reason, and without compensation by Parkland. Reasons for suspension, revocation or termination include, but are not limited to: (i) a circumstance where a Participant intentionally engages in a pattern of activity or behavior that, in the reasonable opinion of Parkland, is intended to circumvent or work around these Terms and Conditions, or the terms and conditions of any participating partners and suppliers; (ii) any abuse by a Participant of any of these Terms and Conditions, any additional applicable terms and conditions or any benefit, privilege or reward associated with the Program; (iii) any misrepresentation by a Participant to Parkland, its affiliates, participating partners or suppliers or to any entity associated with or participating in the Program; (iv) any attempt to participate in the Program via script, macro or other automated means; and (v) any other actions or conduct of a Participant deemed by Parkland, in its sole discretion, to be damaging to Parkland, the Program, or the interests of Parkland’s affiliates, participating partners or suppliers.

Any conduct that is fraudulent or otherwise illegal is prohibited.

Where, in the reasonable opinion of Parkland, a Participant has violated these Terms and Conditions, or Parkland believes that a Participant may have violated these Terms and Conditions, Parkland may, in addition to its other rights and remedies in these Terms and Conditions, at any time and in its sole discretion, take one or more of the following actions: (i) freeze the Account of any Participant while Parkland investigates suspected activity on the part of that Participant; and (ii) refuse to credit the Account of any Participant, or debit the Account of any Participant, including reversal of Points previously credited.

In the event a Participant’s participation in the Program is terminated in accordance with these Terms and Conditions, all accumulated Points will immediately be forfeited.

Parkland reserves the right to restrict or refuse participation in the Program for any reason, in its sole discretion, including, if you do not meet the requirements set forth in these Terms and Conditions, if you are suspected of fraud or illicit conduct or have had an Account previously revoked or terminated by Parkland.

Unauthorized reproduction of any Journie Rewards Card or Phone Number, or fraudulent misrepresentation of an Account is prohibited and can result in legal action.

LIMITATION OF LIABILITY

Parkland (including its affiliates, representatives) assumes no liability to you or any Participant for any reason whatsoever, including without limitation, as a result of any change or termination to the Program (including any changes or removal of participating partners and suppliers), any changes to accumulation or redemption requirements, or for any errors relating to your Account, nor is Parkland responsible for unauthorized access to your Account.

By joining or participating in the Program, you, as the Participant (and your parent or legal guardian, as the case may be), agree to release and discharge Parkland, our affiliates, representatives, and participating partners and suppliers, and each of our and their respective officers, directors, agents, representatives, successors and assigns, from any loss, liability, claim, demand, damage or expense asserted by any person or entity including, without limitation, relating in any way to the Program, your participation in the Program or the accumulation or redemption or use of any product or service obtained in connection with the Program.

Furthermore, Parkland (including our affiliates, representatives and participating partners and suppliers) is not liable in any manner for any tax consequences which result from your participation in the Program. You are solely responsible for the reporting of any income tax benefits and the payment of any taxes.

In no event shall Parkland, including our affiliates, representatives, and participating partners and suppliers, and each of our and their respective officers, directors, agents, successors and assigns, be liable for any direct, indirect, punitive, incidental, special, economic, exemplary or consequential damages of any kind, whether based in contract, tort or otherwise, which arise out of or are in any way connected with your participation, the Program, or these Terms and Conditions.

GOVERNING LAW AND DISPUTE RESOLUTION

This Program and these Terms and Conditions shall be governed by and construed in accordance with the laws of the province or territory in which the Participant resides, and the federal laws of Canada applicable therein, without reference to conflict of laws provisions.

ARBITRATION REQUIREMENT (Not applicable to residents of the Province of Quebec)

You are free to get advice or representation from a lawyer about this arbitration requirement.

Unless prohibited by law, all disputes arising out of or relating in any way to these Terms and Conditions or the Program will be finally and conclusively adjudicated and resolved by arbitration under the Arbitration Rules (“ADRIC Rules”) of the ADR Institute of Canada, Inc. (“ADRIC”), except as modified here. The arbitration will be in English or French as you choose. The arbitration may be held anywhere the arbitrator considers appropriate, including remotely by telephone or Internet.

You will have to pay some fees to arbitrate, as described in the ADRIC Rules.

However, before beginning the arbitration, the party with the claim will first try to informally negotiate with the other party, in good faith, a resolution of the dispute for not less than thirty (30) days but no more than forty-five (45) days unless extended by agreement. During the negotiation period, any otherwise applicable limitation period will be tolled (temporarily suspended).

Nothing here prevents you from filing a claim with a government agency.

This arbitration requirement survives: (i) the termination of these Terms and Conditions, and (ii) the bankruptcy of any party. If any part of it is deemed invalid or unenforceable, the other parts remain in force.

WHERE ARBITRATION REQUIREMENT INAPPLICABLE

If and to the extent the above arbitration requirements are inapplicable, any disputes relating in any way to these Terms and Conditions or the Program shall be adjudicated solely in the applicable court in the province or territory in which the Participant resides, to the exclusion of the courts of any other province or territory.

RIGHTS RESERVED

Parkland reserves the right to extend the Program beyond the Termination Date or to terminate the Program at any time prior to the Termination Date, by posting a revised set of Program Terms and Conditions on the Program website. Once a revised set of Terms and Conditions are posted to the Program website, the revised termination date as contained in that revised set of Terms and Conditions shall automatically apply.

Parkland may change any of these Program Terms and Conditions, Additional Earnings or Rewards, benefits and/or procedures at any time, identifying any amended clauses. The revised set of Terms and Conditions shall govern the Program.

The most recent information posted in these Terms and Conditions or on the Program website pages referenced herein apply in the case of any discrepancy with any information posted elsewhere.

In the event that Parkland is unable to operate the Program as described in these Terms and Conditions for reasons beyond Parkland’s reasonable control, the Program may be restricted, altered, suspended or terminated without notice, and Parkland may restrict, alter, suspend or terminate any aspect of the Program without notice and for any reason. In the event that the Program is restricted, altered, suspended or terminated, Parkland will have no liability whatsoever to any Participant as a result, and all Participants release Parkland from all claims in respect of any Participant's suspension, termination, or any forfeiture of Points, and in respect to any restriction, alteration, suspension or termination of the Program.

Parkland is not responsible for any errors or omissions of any kind, within these Terms and Conditions or as the result of any mechanical or technological failure or as the result of any human error, by Parkland, its employees, agents, by any other person or entity, or for any reason outside of the control of Parkland.

Any failure to comply with, any violation of, any fraudulent activity in relation to, and/or any abuse of these Terms and Conditions in any way may result in the forfeiture of all Points earned and restriction, suspension, and/or termination of the Participant's Account without compensation or notice, at the sole discretion of Parkland.

The Account, Journie Rewards Cards, and App belong to Parkland and may be revoked at any time in its sole discretion. At the option of Parkland, all accumulated Points to that date may be revoked, without any compensation to the Participant, unless prohibited by law.

Any waiver by Parkland of any of these Terms and Conditions at any time does not mean that Parkland cannot rely on these Terms and Conditions at any subsequent time. No delay or omission by Parkland in exercising any right or remedy hereunder shall operate as waiver thereof or of any other right or remedy. If any provision of these Terms and Conditions is invalid or unenforceable, such provision will not affect the validity and enforceability of any of the remaining terms and conditions.

Parkland may from time to time extend the Program to other businesses and other loyalty programs in which case Points earned and Rewards will apply in relation to such other businesses and/or loyalty programs according to the Program Terms and Conditions revised in consideration of changes that may be necessary due to the nature of those businesses and/or loyalty programs and how they relate to the Program. The revised Terms and Conditions will appear on the Program’s website and supersede the previous version of the Terms and Conditions once posted on the Program’s website.
